Photo Booth Rental Agreement & Liability Waiver


1. THE PACKAGE & SERVICES

  • Service Duration: Three (3) hours of active DSLR-quality photo booth service.

  • Included: On-site attendant, choice of standard neutral backdrop (White/Gray/Black), unlimited photo sessions, and a digital gallery.

  • Add-ons (as selected): Flower Wall ($250), Balloon Garland ($200), Shimmer/Sequin Wall ($100), Video Guestbook ($199), Neon Sign ($75), USB ($50), or Print Packages.

  • Customization: The Company will attempt to replicate "inspo" photos (themes, fonts, layouts) provided by the Client. Final artistic interpretation remains with the Company.

2. PAYMENTS & CANCELLATIONS

  • Non-Refundable Retainer: A retainer of $150 is due upon signing to secure the date. This amount is non-refundable as it covers the loss of potential income from other clients for this date.

  • Final Balance: The remaining balance is due 14 days before the event.

  • Idle Time: If setup is required more than 1 hour before active service starts, an Idle Fee of $50/hour applies.

  • Overtime: Service beyond the initial 3 hours is billed at $125/hour.

3. OPERATIONAL REQUIREMENTS & OUTDOOR POLICY

  • Setup Surface: Client must provide a firm, flat, level surface (minimum 10' x 10').

  • Outdoor Events: Equipment must be placed under professional shade (e.g., a tent or permanent overhead structure). If the Company determines the setup area is unsafe (heat, rain, wind), service will be paused until a suitable area is provided. No refunds for lost time.

  • Connectivity: The Company provides a hotspot. If signal is unavailable, the Client agrees to provide Wi-Fi access. If no connection is possible, the Company will sync all media to the digital link within 24 hours of the event.

4. LIABILITY & DAMAGES (THE "NEGLIGENCE" CLAUSE)

  • Client Liability: The Client assumes full financial responsibility for any damage to or loss of the Company’s equipment (booth, camera, backdrops, props, electronics) caused by the misuse, vandalism, or negligence of the Client or their guests.

  • Repair/Replacement: If damage occurs, the Client is liable for the full cost of professional repairs. If the Company deems the equipment irreparable, the Client is responsible for the full replacement value (MSRP) of the equipment.

  • Safety: The Company may cease operations immediately if the attendant feels unsafe or if guests become unruly. No refund will be issued.

5. MODEL RELEASE

Unless otherwise specified in writing, the Client grants the Company permission to use photos taken at the event for promotional purposes (social media, website, advertising, etc.).

6. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas. Any disputes arising from this agreement shall be settled in the courts of Washington County, AR.
